By accessing and using the Web site located at www.puppet.org (the "Web site"), or otherwise availing Yourself of the services, products, and information offered by the Center for Puppetry Arts (the "Center") through the Web site, including the purchase of any products or memberships via the Web site, You agree to be bound by the Terms of Service And Purchase (hereinafter "Terms Of Service" or "Agreement") in effect at the time of each such access, purchase, or other use.
You also acknowledge that the Center may, from time to time, in its sole discretion and without notification to You, modify these Terms of Service. It is Your responsibility to apprise Yourself of any such revision or modifications each time You visit or use the Web site. If You do not so agree, You are not authorized to access or use the Web site in any manner, and You must exit the Web site immediately by clicking on the "Exit" link at the bottom of this page.
The Center for Puppetry Arts is a unique center for puppetry performances and workshops, and houses a one-of-a kind Museum and a Museum Store. Products and Services are available for purchase via the Center's Web site. The Center has created the Web site as a means of providing via the Internet access to information about the various products and services offered by the Center. The Memberships, features, educational materials, information and services that are featured and/or may be purchased from the Center (either via the Web site or otherwise) are collectively referred to herein as the "Services." The various products that, at any given time, are featured and/or may be purchased via the Web site are collectively referred to herein as the "Products."
II. TERMS AND CONDITIONS
A. You Provide Internet Access
In order to access the Web site and/or use the Services, You must obtain access to the World Wide Web, either directly or through devices that access web-based content, and pay any service fees associated with such access. In addition, You must provide all equipment necessary to make such connection to the World Wide Web, including a computer and modem or other access device.

You must be eighteen years old or older to purchase any Product or Services via the Web site.

The Center makes no guarantees regarding the availability of the Web site, the Services, and/or the availability of any given Products referenced in the Web site. THE CENTER FOR PUPPETRY ARTS SHALL HAVE NO LIABILITY FOR UNAUTHORIZED THIRD PARTY ACCESS TO, OR ALTERATION, THEFT, USE OR DESTRUCTION OF, ANY INFORMATION CONTAINED AT THE WEB SITE THROUGH ACCIDENT OR THROUGH FRAUDULENT OR WRONGFUL MEANS OR DEVICES. THE CENTER FOR PUPPETRY ARTS SHALL HAVE NO LIABILITY FOR CONSEQUENTIAL, EXEMPLARY, SPECIAL, INCIDENTAL, OR PUNITIVE DAMAGES EVEN IF THE CENTER FOR PUPPETRY ARTS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY EVENT, THE LIABILITY OF THE CENTER FOR PUPPETRY ARTS TO YOU OR ANY OTHER USER FOR ANY REASON AND UPON ANY CAUSE OF ACTION SHALL BE LIMITED TO AND SHALL IN NO EVENT EXCEED THE SUM OF THE GREATER OF ONE-HUNDRED DOLLARS ($100.00) OR, IN THE EVENT THAT YOUR DISPUTE OR CLAIM ARISES FROM YOUR PURCHASE OF PRODUCTS VIA THE INTERNET, THE COST OF SUCH DISPUTED PRODUCTS (i.e., THE AMOUNT YOU PAID TO THE CENTER FOR PUPPETRY ARTS FOR SUCH PRODUCTS). THIS LIMITATION APPLIES TO ALL CAUSES OF ACTION IN THE AGGREGATE, INCLUDING, WITHOUT LIMITATION, TO BREACH OF CONTRACT, BREACH OF WARRANTY, NEGLIGENCE, STRICT LIABILITY, MISREPRESENTATIONS, AND OTHER TORTS.
NOTE THAT SOME JURISDICTIONS EITHER DO NOT ALLOW OR OTHERWISE LIMIT THE PERMISSIBLE SCOPE OF DISCLAIMERS AND LIMITATIONS SUCH AS THOSE APPEARING IN THE TWO PRECEDING PARAGRAPHS. ACCORDINGLY, SOME OF THE LIMITATIONS AND DISCLAIMERS APPEARING THEREIN MAY NOT APPLY TO YOU.
You agree to indemnify, defend, and hold harmless by the Center, its directors, officers, employees, assignees, and agents, and defend any action brought against same with respect to any claim, demand, cause of action, debt or liability, including reasonable attorneys' fees, to the extent that such action is based upon a claim that: (i) if true, would constitute a breach of any of Your agreements hereunder; and/or (ii) arises out of Your negligence or willful misconduct.
In the event that one or more of the words, phrases, sentences, clauses, sections, subdivisions or subparagraphs contained herein shall be held invalid, this Agreement shall be construed as if such invalid portion had not been inserted. In the event that any invalid language is severed under this paragraph, the severed language shall be comprised of the smallest unit possible such that the severance of the unit results in a valid provision (i.e., a single item in a list will be severed rather than the entire list, a clause will be severed rather than the entire sentence, etc.).
K. Entire Agreement
This Agreement constitutes the entire agreement between You and by the Center with respect to the Services and Products provided and/or purchased via this Web site and supersedes all previous agreements or representations, written or oral, with respect to the Services and Products provided and/or purchased via this Web site. M. Choice Of Venue And Acknowledgment Of Personal Jurisdiction
Any action at law, suit in equity, or other judicial proceeding concerning, relating to, or touching upon in any way this Agreement or the subject-matter hereof, shall be brought or commenced, if at all, only in the Superior Court of Fulton County, State of Georgia, or, if and only if that Court lacks subject matter jurisdiction to hear such claim, the United States District Court for the Northern District of Georgia. By accessing and using the Web site, You submit to personal jurisdiction in Georgia in any action by the Center against You and waive and release now and forever any defense to that assertion of jurisdiction that might otherwise exist.

The waiver by one party of a breach of any provision of this Agreement by the other party shall not operate or be construed as a waiver of any subsequent breach of the same or any other provision by the other party. The failure of a party at any time to require performance of any provision hereof shall in no manner affect its right at a later time to enforce the same.
P. Center for Puppetry Arts Intellectual Property
The Web site contains copyrighted material, trademarks, and other proprietary information which may include text, software, photos, video, graphics, music and sound. The entire contents of the Web site are copyrighted as a collective work under the United States copyright laws. The Center owns a copyright in the selection, coordination, arrangement and enhancement of such content, as well as in the content original to it. You may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit, any of the content, in whole or in part. Except as otherwise expressly permitted under copyright law or expressly allowed herein, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material will be permitted without the express permission of the Center and the copyright owner, if other than the Center. In the event of any permitted copying, redistribution or publication of copyrighted material, no changes in or deletion of author attribution, trademark legend or copyright notice shall be made. The trademarks and service marks on the Web site, along with other logos and product and service names used on the Web site, are trademarks of the Center or its suppliers (the "Marks"). U. Additional Terms Applicable To Web Site Purchases
1. "Authorized Purchaser" Information
YOU MUST BE AN AUTHORIZED PURCHASER TO PURCHASE PRODUCTS FROM THE CENTER FOR PUPPETRY ARTS WEB SITE. BY MAKING OR ATTEMPTING MAKE A PURCHASE, YOU WARRANT AND REPRESENT THAT: (1) YOU ARE AUTHORIZED BY LAW TO MAKE SUCH PURCHASE; (2) ALL PURCHASE-RELATED INFORMATION YOU PROVIDE IS TRUE, COMPLETE, AND ACCURATE AT THE TIME YOU PROVIDE SUCH INFORMATION, AND THAT YOU WILL UPDATE THE INFORMATION FROM TIME TO TIME AS IT MAY CHANGE; AND (3) YOU ARE 18 YEARS OF AGE OR OLDER.
2. Availability And Means Of Purchase
You may order the Center Products described in the Web site by telephone, fax or via the Web site. You may also purchase the Products at the Museum Store.
3. Errors In Pricing
If the Center makes an error in the price of a Product or Service listed on the Web site, the Center shall have 72 hours in which to cancel any sales made electronically at the erroneous price. Purchasers whose order contains an erroneous price shall be notified within 72 hours of their attempt to purchase. At its sole discretion, the Center may elect to honor such errors in price.
4. Product Shipment And Delivery
The Center shall not be liable for any delay or failure to deliver Products or otherwise perform (other than a refund of monies paid in the instance of a complete failure to ship), including but not limited to any instances where such failure or delay has been occasioned by matters such as fire, flood, embargo, strike, lockout, act of God, shortage of raw material or power, terrorist act, governmental action or compliance with governmental requirements, whether voluntary or pursuant to order, or any other circumstance beyond the Center's control. The Center reserves the right to fill orders by complete or partial shipments. Finally, all items purchased from the Center are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to You upon Our delivery to the carrier. Products may be shipped to Your address or to another address specified by You with Our approval.
5. Returned Goods Policy
Products that You purchase may not be returned, without the prior consent and authorization of the Center, which may be given or withheld in its sole discretion. Such Products will be considered for return only if (i) the Products are defective, covered by the manufacturer's warranty and such defect is reported by You to the Center within the manufacturer's warranty period by the original consumer purchasing the Product for use (and not resale), or (ii) the Products otherwise fail to conform to the order that You placed. In the event that the Center approves any such returns, You are responsible for paying the shipping costs for any returned Products. Upon receipt of the Product, the Center will inspect the Product to confirm the defect. Upon confirmation of the alleged defect, the Center will at customer's option, either: (a) credit customer's account for the purchase price; or (b) replace the returned Products. Conversely, in the event that the Center disputes the presence of the alleged defect, the Center will contact You and attempt in good faith to negotiate a mutually-satisfactory resolution to the dispute.
With respect to ticket purchases, you will be given a raincheck upon arrival if the number in your party is less than the number of tickets you have purchased. Under no circumstances will refunds for tickets be provided.
The Center attempts to be as accurate as possible in relation to descriptions and other information provided on the Web site. However, the Center does not warrant that Product descriptions or other content of this site are accurate, complete, reliable, current, or error-free. If a Product offered or sold by the Center itself is not as described, Your sole remedies are set forth herein. You acknowledge and understand that any descriptive information regarding any given Product referenced in the Web site was provided by the manufacturer of the Product (a third party other than the Center) and that, except as expressly described herein, Your sole remedies for non-conforming or defective products lies with the Product manufacturer. You may return and exchange items purchased on the Center for Puppetry Arts online Museum Store per our policy as detailed below. Items may be mailed to the Center for Puppetry Arts or returned in person during Store hours (Tues-Fri, 9am-2pm; Sat, 9am-5pm; Sun, 11am-5pm).
A refund will be made only if all of the following conditions are met:
· All returns must be new, unused, contain all original product packaging and accessories, and be in their original condition;
· All returns must include the original packing slip;
· Return must be received by the Store within 30 days of the shipment date listed on your packing slip.
A refund will not be made for:
· Any item has obvious signs of use;
· Any CD, DVD, VHS tape or cassette tape that has been opened (taken out of its plastic wrap);
· Any item that is not in its original condition, is damaged, or is missing parts.
· Shipping and handling charges;
· Any and all ticket purchases.
All determinations with respect to whether or not a return item meets the return requirements above are within the sole discretion of the Center and its staff.
Receiving Your Refund
If you personally bring your return item to the Center's Store and it meets the refund criteria above, the return will be refunded immediately in the form of the original payment method.
If you mailed your return item to the Center and it meets the refund criteria above, the return will be refunded in the form of the original payment method within 7 - 14 business days of the Center's receipt of the returned item and you will be notified of the refund via electronic mail. If the return item does not meet the refund criteria, you will be so notified via email and you will be requested to either pick-up the item at the Store or provide us further instructions.
To exchange an item by mail, include the original packing slip and indicate the item you are returning and the new item(s) you want. Please be as specific as possible when describing the new item. For example, give the item name, color, size, and so on. An exchange item must be received by the Store within 30 days of the shipment date listed on your packing slip.
The return item will be credited to the original payment method and the new item(s) will be charged to the same payment method. Shipping charges for the returned item are not refundable. All charges for shipping the new item(s) will be charged to you using the same payment method.
To exchange items at the Store, please bring your original packing slip with the exchange item(s) within 30 days of the shipment date listed on your packing slip.

You are responsible for paying the shipping costs, when applicable, for any returned or exchanged item(s). Shipping charges are not refundable.
